The past payments made by Medicare upon the condition that they would be reimbursed at the time of Settlement must be taken into consideration. FARA understands that a proactive Conditional Payment investigation and resolution approach to these liens ensures Medicare’s interest was taken into account but there also were no payments reimbursed that were not part of the claim.
